When you say “clear-cut case of UC-Theft of Tournament Materials”
remember this section from the MTR - 2.10 Dropping from a Tournament
Players who drop during limited events own the cards that they correctly have in their possession at that time. This includes any unopened or partially drafted boosters.
This is a valid way for the player to retain the Fetch Land, although they won't be playing in the current event with it.

Jon, are you sure you're looking at
the March 2015 version of the MTR? The
exception you're looking
for is listed in 7.3.

Aha, there's the bit that I was
missing.
I think a concern regarding 7.5's wording may still
be that unscrupulous players could try to claim there is justification
for keeping the fetch (as it is “not from the expansion of the
opened booster”)
However, this is a clear-cut case of
UC-Theft of Tournament Materials given the definition that it can be
played in the
tournament.
