It might be possible in some scenario (EDIT: And that may be getting further and further afield into “Cornercaseville”), but the only implicit statement a player makes when they present their deck to their opponent is that it is (a) legal and (b) sufficiently randomized. (See MTR 3.9) Other than that, the player is not making any statement as to the exact number of cards in the deck, other than “legal amount”.

Really, for Tournament Error–Communication Policy Violation, you'd have to get the player to be explicit on the number of cards in the deck, especially during the game in progress.
