HCE and LEC

My only concern with the is it HCE or LEC ideal is that we will rely heavily on the honesty of the opponent. if the opponent tells you he does not really know what happened and has no idea of the order of the cards it comes down to a judgment call every time which could cause inconsistency in rulings.

There's a potential window, yes, but this is why we have judgment and an ability to investigate the situation. Remember that:

That should probably say “only what information is publicly available”, to mirror the line in the definition, but the philosophy is clear: NAP cannot secure a more severe infraction and fix by “forgetting” the necessary information. If, in your judgment, it is clear which card was the last one picked up, and it is clear that they were not shuffled or recordered, I would lean towards LEC..
