I don't understand part of the solution for latest Knowledge Pool scenario.

Summary of the scenario: AP has 59 card deck and 16 card sideboard and decklist matches with the deck and sideboard. He made a mistake both registering and preparing his deck and sideboard for the tournament.

Current defintition for Tournament Error - Deck Problem is:
Definition
The contents of a deck or sideboard do not match the decklist registered and the decklist represents what the player intended to play.

However we have this upgrade statement:
Upgrade: If the deck is discovered to be incorrect during the presentation period, and the missing cards are not in the opponent’s deck, the penalty is a Game Loss.

In the solution it states we must apply an upgrade from an infraction that technically is not happening according to current definition. Both deck and sideboard match with the submitted decklist.
So, why should we apply the upgrade in this scenario?
